Terms of Service

These Terms of Service govern your use of the Roomy app. Please read them carefully. By downloading or using Roomy, you agree to these terms.

Acceptance

These Terms of Service ("Terms") are a legal agreement between you and Nicolas Vrillac ("we", "us", or "our"), the developer of the Roomy app ("Roomy" or "the app"). By downloading, installing, or using Roomy, you confirm that you have read, understood, and agree to be bound by these Terms and by our Privacy Policy. If you do not agree, do not use the app.

License to Use the App

We grant you a personal, limited, non-exclusive, non-transferable, revocable license to download and use Roomy on Apple devices that you own or control, solely for your own personal, non-commercial use, and in accordance with Apple's App Store Terms of Service.

You may not copy, modify, reverse engineer, decompile, resell, or distribute the app or any part of it, except to the extent that such restrictions are prohibited by applicable law. All intellectual property rights in the app remain with us.

Subscriptions, Free Trial and Billing

Roomy offers premium features through "Roomy Pro". Roomy Pro is available in the following options:

Billing is handled by Apple through the App Store using the payment method associated with your Apple Account. The following terms apply:

• Auto-renewal: The Weekly plan automatically renews at 9.99 USD per week unless you cancel it at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours before the end of the current period.
• Free trial: The Weekly plan includes a 3-day free trial. If you do not cancel before the trial ends, it converts into a paid subscription. Any unused portion of a free trial is forfeited when you purchase a subscription.
• Lifetime purchase: The Lifetime option is a single one-time payment of 49.99 USD and does not renew.
• Managing and cancelling: You can manage or cancel your subscription at any time in your Apple Account settings in the App Store. Cancellation takes effect at the end of the current billing period.
• Refunds: All purchases are processed by Apple. Refunds are handled by Apple in accordance with their policies, and requests should be directed to Apple. We do not process payments directly and cannot issue refunds on Apple's behalf.

Prices are stated in US dollars and may vary by region and over time. Any price shown at the time of purchase in the App Store governs that transaction.

Acceptable Use

You agree to use Roomy only for lawful purposes and only for content that you own or have the right to use. You agree not to:

• Use the app in any way that violates applicable laws or regulations.
• Upload or store content you do not have the right to store.
• Attempt to gain unauthorized access to the app, our servers, or other users' data.
• Interfere with, disrupt, or attempt to circumvent the security or intended operation of the app.

SafeKeep and Your Content

SafeKeep lets you back up photos and videos you choose to an end-to-end encrypted cloud vault. Your content is encrypted on your device before upload, and we store only the encrypted copy. Please understand the following:

• You are responsible for the content you choose to back up and for ensuring you have the right to store it.
• We store only encrypted copies of your content. We cannot read, view, or recover the contents, because the encryption key never leaves your device.
• SafeKeep is a convenience feature and is not a substitute for your own backups. You should keep your own independent backups of anything important.
• If you lose access to your device or the encryption key, your encrypted data may be permanently unrecoverable. We cannot restore it for you.

Disclaimers

Roomy is provided on an "as is" and "as available" basis, without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the app will be uninterrupted, error-free, secure, or free of data loss, or that it will meet your specific requirements.

Features such as duplicate detection, blur detection, compression, and de-duplication are provided as tools to assist you. You are responsible for reviewing results before deleting or modifying any files or contacts.

Limitation of Liability

To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, photos, videos, contacts, profits, or goodwill, arising out of or related to your use of, or inability to use, the app. Our total liability for any claim relating to the app will not exceed the amount you paid for the app in the twelve months before the claim arose.

Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.

Governing Law

These Terms are governed by and construed in accordance with the laws of France, without regard to its conflict of law principles. Any disputes arising under these Terms will be subject to the courts located in France, unless applicable law requires otherwise.

Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the "Last updated" date at the top of this page. Significant changes may also be communicated within the app. Your continued use of Roomy after an update means you accept the revised Terms. If you do not agree to the changes, please stop using the app.
